Tornado Cash: developer Alexey Perstev sentenced to more than 5 years in prison in the Netherlands

On Tuesday in the Netherlands, Tornado Cash developer Alexey Perstev was sentenced to 64 months in prison. Although he was released for the first time last year, the person concerned finds himself once again behind bars, which reignites the debate on the right to confidentiality.

Tornado Cash affair: Alexey Perstev returns to prison

This is a matter initiated almost 2 years ago now, when the US Treasury placed Tornado Cash mixer addresses on the Office of Foreign Assets Control (OFAC) blacklist. Shortly after, Alexey Perstev, one of the major developers of the protocol, was arrested in the Netherlands, before being released on April 28, 2023.

However, last March, the Dutch justice system unveiled an indictment for the charges against him. It was therefore on March 26 that his trial began to judge the role he would have played in facilitating the laundering of 1.2 billion dollars, notably from major hacks in the industry such as that of the Ronin bridge.

So, the verdict fell on Tuesday, and Alexey Perstev was sentenced to 64 months in prisonthe equivalent of more than 5 years behind bars.

Judge Henrieke Slaar characterized Tornado Cash as a “tool for criminals“, And this “by its nature and functioning“. Subsequently, she rejected the arguments defending the project’s open source values:

As since the beginning of the Tornado Cash affair, this reopens the debate on the right to confidentiality.

For the moment, the 8 months of imprisonment already served between 2022 and 2023 will be deducted from the sentence that Alexey Perstev remains to serve, while his lawyers have 14 days to appeal if they wish. For his part, Roman Storm, another developer of the project who was arrested in the United States in August 2023, must be tried on September 23.
